Acceptance of Terms

By accessing DivineMatch.Net ("Platform"), creating an account, or using our matchmaking services, you agree to these Terms & Conditions ("Terms"), Privacy Policy, and any updates. If you do not agree, do not use the Platform. You must be the account holder; no sharing allowed. We may update Terms with 7 days' notice via email or site post—continued use constitutes acceptance.

These Terms form a binding contract under the Indian Contract Act, 1872. You represent you have read, understood, and consent freely. Minors or unauthorized users void all protections.

Limitation of Liability

We are NOT liable for match outcomes, relationship results, emotional distress, third-party conduct, accuracy of user data, or any indirect / consequential damages. Total liability capped at fees paid or INR10,000 (whichever is lower).

• No liability for user interactions off-platform, including meetings, harassment, or crimes—users assume all risks.
• We disclaim all warranties, express/implied, including merchantability, fitness for purpose, or non-infringement. Platform provided "as is."
• Exclusions apply except for gross negligence, fraud, or death/personal injury (non-waivable under law).

Indemnification

You agree to defend and indemnify us against claims arising from: your content, misuse, violations of rights or laws, fraudulent activity, defamation, or breach of these terms.

• Covers all losses, damages, costs (including attorney fees), and expenses from your actions, including third-party claims (e.g., IP infringement by your photos/content).
• You must notify us promptly of claims and cooperate in defense. We control settlement/handling.
• Survives account termination. No cap on your indemnity (unlimited, per standard Indian practice).

Binding Arbitration & Dispute Resolution

All disputes resolved by binding arbitration under Arbitration & Conciliation Act 1996. Seat: Your City, India. Language: English. Class action waiver applies. Exceptions only for IP injunctions or enforcement of award.

• Governing Law: Exclusive jurisdiction of courts in Mumbai, India. No foreign law applies.
• First escalate to our Grievance Officer (details below) within 15 days; unresolved in 30 days → arbitration.

Intellectual Property Rights

Platform content owned by DivineMatch.Net. You grant us a non-exclusive license to host, display, adapt, and transmit your submitted profile content & images for matchmaking. No scraping, reverse engineering, or unauthorized commercial use.

• You warrant your content doesn't infringe third-party rights; you indemnify us for any claims.
• On termination, we may retain content for legal/compliance (up to 7 years).

User Eligibility & Profile Accuracy

• You must be 21+ (males) or 18+ (females), legally competent, and not barred by law. Provide truthful ID for verification.
• Profiles must be accurate, current, and solely yours—no fakes, spam, or proxies. Update within 48 hours of changes.
• We may suspend/terminate for violations; no refunds. You consent to automated/manual reviews.

Prohibited Conduct

We prohibit harassment, scams, illegal activities, hate speech, or commercial solicitation. Report violations to support@divinematch.net.

• Examples: Fake profiles, soliciting money/sex, sharing malware, or violating privacy.
• You agree to our reporting to authorities (e.g., under IT Act for cybercrimes). We cooperate with law enforcement.
• Violations lead to immediate termination; you waive claims against us for enforcement.

Miscellaneous Clauses

• Entire Agreement, Severability, Assignment, Force Majeure, Notices, Survival, Waiver included.
• Force Majeure covers outages, disasters, pandemics, civil unrest.
• Severability: Invalid clauses don't void the rest. Waiver: No delay in enforcement waives rights.
• Assignment: We may assign to affiliates; you may not without consent.
• Survival: Indemnity, IP, liability caps survive termination.

Privacy & Data Retention

• Active accounts retained while active +2 years post deletion (some longer for legal).
• Right to deletion requests processed within 30 days.
• Payment & compliance records retained 7 years.
• Complies with DPDP Act, 2023: Consent for data use; rights to access/correct/erase. No sale of data.
• Security: We use encryption; notify breaches per IT Rules.

Cookie Policy Summary

• Essential (auth/session), Analytics (usage metrics), Functional (preferences).
• Third-party: Google Analytics, Razorpay/Stripe, GCP, reCAPTCHA.
• You consent via browser settings; opt-out available.

Age Verification & Minor Protection

• Minimum: 21 (Male), 18 (Female). Automated validation + admin review.
• Profiles created for others require proper consent and truthful data.
• We report suspected minors/child exploitation to authorities (POCSO Act compliance).

Data Breach Notice

We notify affected users within 72 hours after confirmation; CERT-In within mandated time. You may request deletion post-breach.

Consumer & Refund Rights

Refunds as per posted policy; 24-hour cooling-off may apply. Disputes escalate per Consumer Protection Act. Arbitration preferred for resolution.

• 7-day return for digital mismatches (e.g., profile errors); no refunds for "no matches."
• Grievance Officer: support@divinematch.net; resolve in 48 hours, escalate to CCPA if needed.

Payments & Taxes

• All fees non-refundable except as stated. Processed via secure gateways (RBI-compliant).
• You handle your taxes; we deduct TDS if applicable (IT Act).
• No chargebacks; disputes via arbitration only.

Termination

We may terminate for breach, inactivity (6 months), or law changes. You may delete account anytime (data retained per policy). No liability for termination effects.
